Customs Clearance

For reference:
 — paragraph 2 of Article 8 of the Agreement On the Movement of Goods by Individuals for Personal Use through the Customs Border of the Customs Union and Customs Operations related to their Release:
Vehicles for personal use that are transported by any means, except the vehicles for personal use registered in the territory of the member states of the Customs Union, and that are temporarily exported from the customs territory of the Customs Union and imported back to such territory shall be subject to the customs declaration in writing”;
 — first part of Article 11 of the Agreement On the Movement of Goods by Individuals for Personal Use through the Customs Border of the Customs Union and Customs Operations related to their Release:
“Vehicles for personal use that are registered in the territory of a foreign state and that are temporarily imported by any means into the customs territory of the Customs Union by the foreign individuals with the exemption from the payment of the customs duties can be used within the customs territory of the Customs Union by the individuals that imported such vehicles”;
 — paragraph 3 of Article 358 of the Customs Code of the Customs Union:
“The assignment of rights for use and (or) disposal of the temporarily imported goods for personal use, including vehicles, to another person in the customs territory of the Customs Union shall be allowed on condition of the customs declaration of such goods and payment of the customs duties in the manner established by the customs legislation of the Customs Union”;
 — part 2 of Article 14.7. of the Code of the Republic of Belarus On Administrative Offences:
“The use of the vehicles that are under customs control in violation of the order established by the legislation:
The assignment of rights for use and (or) disposal of the vehicles that are imported into the customs territory of the Eurasian Economic Union for the personal use and that are registered in the territory of a foreign state to the other persons in violation of the established order, as well as the failure to export from the customs territory of the Eurasian Economic Union such vehicles before the established expiration date of the temporary import
 — is punishable by a fine in the amount from five to thirty base value* with the confiscation of vehicles regardless of whose property the vehicles are in or without confiscation”.


* As of 01.01.2017 the base value is equal to 23 Belarusian ruble (approx. 11,2 Euro).
